Volkswagen Litigation Survey

On September 18, 2015, the U.S. Environmental Protection Agency announced findings that Volkswagen had installed software on diesel cars that enabled them to cheat on emissions tests. These so-called "defeat devices" reduced nitrogen oxide emissions when the cars were placed on a test machine but allowed higher emissions during normal driving. The manufacturers installed the cheating emissions software on more than a half-million diesel cars in the U.S. and roughly 10.5 million more worldwide.

Civil and criminal actions and investigations were initiated as a result, and three consumer class action settlements have resulted to-date. Unfortunately, VW owners who purchased and sold their vehicles before September 18, 2015 were excluded from these settlements, as were VW lessees who turned in their lease before September 18, 2015.
