The Basics
COVID Business Insurance Disputes
Has your insurer unreasonably delayed or denied your claim? If so, your insurer may have violated its obligation to act in a way that will not injure you. Because injury in the context of business insurance claims includes preventing policyholders from receiving the benefits of their policies, denial of a claim might entitle you to compensation for your losses.
The Paynter Law Firm’s experienced team can help represent businesses who have been impacted by insurers acting in bad faith. Our recent string of successes in business insurance coverage litigation has quickly made us a top competitor for commercial policyholders seeking assistance in these challenging and unprecedented times. We are ready to support you.

How we help
Filing a Claim
We can help you identify potential coverage and provide you with guidance on how best to secure that coverage for your business. Often, it can be helpful to retain the advice of counsel as early in the process as possible (especially, for example, prior to filing your claim). If you have already filed a claim and your claim is still being processed or has been denied, we are available to litigate your claim as well. No matter where you are in the process, we can help.
We offer a variety of client representation models, including contingency fee (which means you wouldn’t pay anything until we have successfully secured coverage for you), hourly, or a combination of the two.
At Paynter Law, we help:
- Provide a free preview of your business insurance policy
- Identify available coverage under your existing business insurance policy
- Identify and review any policy restrictions and exclusions
- Clarify complexities in insurance code and case law
- Insist insurance adjusters review claims in a timely manner
- Help protect your ability to recover if litigation becomes necessary
- Litigate your claim if it is denied by the insurance company
We’re here to help walk you through the entire process.

First In The Nation
Cincinnati Insurance Company Litigation
Paynter Law secured a landmark victory when the North Carolina Supreme Court ruled that The Cincinnati Insurance Company must pay business interruption coverage for losses suffered by 16 restaurants due to Covid-19-related government shutdown orders. At least 21 state supreme courts had previously ruled on whether insurers owe such losses, but Paynter Law’s action represents the first and only case in the country where a supreme court has definitively required an insurance company to pay. The NC Supreme Court’s opinion is a final judgment that cannot be further appealed.
The Plaintiff-restaurants include Vin Rouge, Parizade, Mateo Bar de Tapas, Rosewater, Mothers & Sons Trattoria, Saint James Seafood, Lucky’s Delicatessen, Bin 54, City Kitchen, Village Burger, Nasher Cafe, Local 22, Kipos, Golden Fleece, Farm Table, and Gatehouse Tavern, and are owned and operated by Matthew Kelly, Giorgios Bakatsias, Jay Mehdian, and Laszlo Lukacsi, local chefs, businessowners, and multi-time James Beard award nominees who helped ignite the region’s culinary renaissance. “This unanimous ruling provides definitive confirmation of what my clients have known all along: that their insurance policy provides coverage for pandemic-related losses,” says lead attorney for the Plaintiffs, Gagan Gupta. “It’s a groundbreaking and powerful win for policyholders still recovering from the economic devastation brought about by Covid-19.”
